General Terms and Conditions of Service

These General Terms and Conditions of Service, along with the policies relating to the services provided as stated on the Clipily website, form a legal agreement between you, the customer, and Clipily, covering both our traditional services and our expanded creative and development services. By engaging with Clipily, you agree to these terms, which outline our mutual expectations and obligations.

Creative and Development Services

In addition to image editing and management, Clipily offers a range of creative and development services, including but not limited to graphic design, website development, and digital marketing solutions. You agree to provide us with all necessary information, materials, and approvals required for the successful completion of these services. Clipily retains the right to reject projects based on content, feasibility, or ethical considerations.

Images and Adjustments

You are responsible for the images and content you submit to us and warrant that you have the legal right to use them. Ownership of submitted content, whether images or other materials, is never transferred to Clipily. We reserve the right to review submitted materials for inappropriate content and to reject any material for any reason. Materials returned to you are deemed accepted unless we are notified of any errors within seven (7) days following delivery.

Delivery and Download

We prioritize orders based on the requested delivery time and exert commercially reasonable efforts to meet these timeframes; however, we cannot guarantee precise delivery times. You will receive email notification when your order, whether an image or a development project, is ready for review and download. Content will be removed from our systems fourteen (14) days after you have confirmed acceptance.

Cancellation and Refunds

Orders may be cancelled under the terms specific to the type of service ordered. For standard delivery services, cancellation is possible up to one hour after the order is placed. For express or development services, specific cancellation terms will be provided based on the scope and nature of the work. Refunds and credits will be issued according to the specific conditions outlined at the time of order.

Payment

Payment terms for services provided by Clipily, whether via credit card, debit card, or invoice, are governed by the terms set forth by the respective payment processors and by Clipily’s policies. All payments must be made in accordance with the instructions provided by Clipily. Late payments may incur additional charges as detailed in the service agreement.

Changes to Services or Terms

Clipily reserves the right to modify services, policies, and these terms and conditions at any time. Significant changes will be communicated to you prior to implementation. Continued use of Clipily’s services after changes signifies your acceptance of the new terms.

Limitation of Liability

Clipily and its subcontractors are not liable for indirect damages such as data loss, lost profits, or other incidental damages, except as required by law. Our liability is limited to the scope of the services provided and the fees paid by you.

Force Majeure

Clipily is not liable for delays or failures in service delivery resulting from events beyond our control. This includes natural disasters, governmental actions, or technological failures not attributable to Clipily’s negligence.

Governing Law and Dispute Resolution

These terms and any disputes arising from them are governed by Swedish law and will be resolved in the Stockholm District Court, respecting your statutory rights.
